Avanti Mind Ltd is a company registered in England and Wales (company number 16049394, registered office: The Venture Centre, Sir William Lyons Road, University of Warwick Science Park, Coventry, England, CV4 7EZ). In these terms, 'Avanti', 'we', 'us' and 'our' mean Avanti Mind Ltd; 'you' and 'your' mean the person or organisation using our products or this website.
By creating an account, you agree to these terms. If you do not agree with them, please do not create an account or use our app, platform or robots.
2A note on our current stage
In development, with early access by enquiry for households and fleet operators. At present, this website provides information about our products, lets you make an early access enquiry, and lets you contact us. Nothing can be bought, subscribed to, ordered or started as a free trial on this website, and live billing is not switched on. Our robots are not on sale and the fleet platform is not open for general sign-up.
Section 5 and Section 6 are not offered today. They are kept, with their numbers, only so that links to them keep working. If buying a robot or taking a subscription is ever offered, the terms for it will be published and shown to you, and will apply only once you have accepted them at the point you make a purchase or start a subscription.
3Using this website
You may use this website for lawful purposes only. You agree not to:
- use the website in any way that breaks the law or any regulation;
- attempt to gain unauthorised access to the website, its servers, or any connected systems;
- interfere with the website's normal operation, or introduce anything malicious;
- or copy, reproduce or redistribute the website's content other than as reasonably needed to use the site as intended.
The content of this website (text, design, logos and the Avanti and Avanti Robotics brands) belongs to Avanti Mind Ltd or its licensors and is protected by intellectual property law.
4Early access enquiries and updates
When you make an early access enquiry or ask to hear from us, you give us your email address and any other details you choose to provide. We use them to reply to you and to keep you informed about Avanti Robotics, as described in our privacy policy.
Making an enquiry places no obligation on you. It is not an order, it is not a contract to buy, and no payment is taken. You can ask us to remove your enquiry or stop updates at any time.
5Buying a robot (not offered today)
Not offered today. Robots are not on sale, and you cannot order, pay for or reserve one on this website. Terms for buying a robot will be published before any sale opens, and a contract will be formed only on those terms. Nothing in these terms reduces your statutory rights as a consumer.
6Subscriptions (not offered today)
6.1 Consumer subscriptions
Not offered today. There is no consumer subscription you can take on this website, and live billing is not switched on. Households can ask for early access through the early access form.
6.2 Business subscriptions
Not offered today. There is no plan, price or free trial offered on this website, and live billing is not switched on. Fleet operators can ask for early access through the early access form. Any business plan will have its own terms, shown to you and accepted by you before it starts.
6.3 Changes to subscription pricing
There are no subscription prices to change today. If subscriptions are offered, a change to the price of a subscription you hold will take effect only from your next billing period, after reasonable advance notice, and you may cancel before it takes effect.
7Acceptable use of the app and platform
When you use the companion app or the fleet platform, you agree to:
- provide accurate account information and keep your login credentials secure;
- use the app or platform only for lawful purposes, and in line with these terms;
- not attempt to access another user's or another organisation's data;
- not attempt to disrupt, reverse-engineer, or gain unauthorised access to the platform;
- and not use the platform to infringe anyone's privacy or other rights, for example by using a robot's camera or microphone to monitor someone without a lawful basis to do so.
You are responsible for activity carried out under your account. For business customers, the account owner is responsible for the users they invite and the roles they assign, and for ensuring their organisation's use of robots complies with the law, including data protection law where robots capture images, audio or location data.
8Robot operation and connectivity
Robots connect to the platform over the internet. Connectivity enables features such as real-time alerts, the dashboard, and over-the-air updates. You understand and accept that:
- some features depend on an internet connection and on third-party networks and services, and may be unavailable if connectivity is interrupted;
- a robot must connect periodically to receive security and software updates and to maintain its device certificate;
- and a robot is a physical device operating in a real environment, and you are responsible for using it safely and in line with the guidance we provide.
9Care features are not an emergency service
Care features are not an emergency service. A robot may not detect a fall or hear a call for help, and an alert may arrive late or not at all, for example if the connection is lost or nobody in the household sees it. Do not rely on Avanti Robotics as the only way a person can get help. In an emergency call 999. Nothing in this section limits our liability for death or personal injury caused by our negligence.
10Software updates
We provide over-the-air updates to improve the robots and the platform. By using our products, you agree that we may deliver these updates. Updates are cryptographically signed and verified by the robot before they are applied. Some updates may be necessary for security or continued operation.
11Intellectual property
All software, designs, content, the Avanti and Avanti Robotics brands, and other intellectual property in our products, the platform and this website belong to Avanti Mind Ltd or its licensors.
If robots are put on sale and you buy one, you will own that physical robot. The software that runs on it and on the platform is licensed to you, not sold. You receive a personal, non-transferable, revocable licence to use it for the intended purpose, for as long as you comply with these terms.
You retain ownership of the data you and your robots generate. You grant us the permissions we need to process that data to provide the products and the services described in our privacy policy.
12Availability and our responsibilities
We work to keep the website, app and platform available and working well, but we cannot guarantee uninterrupted availability. We may suspend access for maintenance, updates, or for reasons outside our reasonable control. We provide our products and services with reasonable care and skill, as UK law requires. Where we offer service-level commitments to business customers, those will be set out in the relevant plan terms.
13Limitation of liability
Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for any of your statutory rights as a consumer that cannot be excluded.
Subject to that:
- we are not liable for losses that were not reasonably foreseeable, or for losses not caused by any breach on our part;
- for business customers, our liability arising out of or in connection with these terms will be limited as set out in your organisation's written agreement with us;
- we are not responsible for a failure caused by your home internet connection, your mobile network or your power supply, or by events outside our reasonable control; if that happens we will tell you and do what we reasonably can to limit the effect.
14Suspension and termination
You may stop using the website at any time, and you may close your account or cancel a subscription as described in Section 6 if subscriptions are offered. We may suspend or end your access to the app or platform if you break these terms in a serious way, for example by attempting to access others' data or by using a robot unlawfully. Where it is reasonable to do so, we will warn you first and give you a chance to put things right.
15Changes to these terms
We may update these terms as our products develop or as the law changes. When we make a significant change, we will update the 'last updated' date. We will give you notice of a material change before it takes effect. If you do not agree, you can stop using the product and close your account before it takes effect.
16Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, except that, if you are a consumer resident elsewhere in the UK, you may also bring proceedings in the courts of the part of the UK in which you live.
